Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013

In all the years we have been trading we have never had a customer's covers lost or damaged, however this is important information for when you have sent us covers for us to fit the new foam in to. We will double wrap your parcel in heavyweight polythene and use a reputable courier to deliver your cushions but if the parcel containing your covers is lost or damaged in transit we will only be liable for the cost of the replacement foam and the cost of replacing the covers. All effort would be made to match as closely as possible the fabric but an exact match may not be practically possible. When you post us your covers to have new foam fitted you are accepting this condition. We will not be held liable for any further cost.

Please note: We do not pass your details on to any third party except where required to complete your order i.e. the couriers will be given your name, address and phone number.

Please read these terms carefully, and print and keep a copy of them for your reference.

Making a contract with us:

When you place an order with us, you are making an offer to buy goods. We will send you an email to confirm that we have received your order. Once we have checked the price and availability of the goods we will either phone you or email you again to confirm that we accept your order, and that a contract has been made between us. We will not take payment from you until we have accepted your order. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. If our card processors or Paypal do not authorize your order payment, you will not receive an email or phone call confirming acceptance of your order, and there will be no contract between us.

How to place an order:

Orders are taken in English and the contract will not be filed with any external organisation. On-line - Click 'Add to Cart'; you will then be transferred to our shopping cart where you are required to fill in your invoice and delivery details, when you have done that you will be transferred to our secure payment processors (currently Paypal) where you will enter in your payment details, alternatively you can telephone us with your requirements or post us an order. On-line Credit/Debit card payments are accepted using a secure server. If you have progressed to the shopping cart and wish to amend an order please delete the number of items in the shopping cart and re-order the correct item

Delivery:

Orders are delivered using a courier. There is a delivery charge of £10 per order. We will advise you either by phone or email when your order is likely to be delivered. Although foam will have to be cut to your specific sizes most orders are delivered within a week.

Prices:

The prices shown on our web site include V.A.T. @ 20%.

Cancellation and returns:

This policy does not apply to the following, where goods have been produced and supplied to a customer's specification (i.e. foam cut to size), the customer shall not be entitled to return the goods for either a refund or credit should the goods not prove suitable for the customers particular application. The placing of an order accepts normal working tolerances of +/- 4mm (0.25") of any dimension. For any other items you can cancel your contract at any time up to 14 working days after the date of delivery. To do this please email or write to us. You do not have to give any reason for cancellation. However, a brief description will help us to improve the service we offer to customers in the future.

If you cancel, you must return the goods to us at your own expense. You must ensure that the goods are packaged adequately to protect against damage.

If you fail to return the goods, we will collect them, and we will charge you for the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

We will refund you the price you paid for the goods and delivery cost that you were charged at the time of ordering in full within 14 days of us receiving the goods back. We will not refund you though the cost for you to return the order to us.

This cancellation policy does not affect your legal rights - for example if goods are faulty or mis-described.

Consumer rights:

If any of goods are faulty, & not of satisfactory quality (see note 1) or do not match how they were described (see note 2), the customer is entitled to reject them and claim a refund.

(Note 1) Please ensure that your order the correct foam for your requirements, we will advise you the best we can.

(Note 2) The comfort of foam is subjective and the 'feel' of foam will vary with time and use. Please contact us and we will advise you the best we can as to which foam will be most suitable for you.

Faulty goods:

If there is a problem with the goods, please contact us. We will deal with the matter in accordance with your legal rights. These terms were last changed on 17.08.16

These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

Payment terms:

For orders placed over the telephone or by post for collection from our Leamington Spa store payment may be made on collection. For orders being delivered to your delivery address, payment must be made at the time of placing the order.

Complaints procedure:
